The Cost of Eviction

 Eviction is a tough process for the one doing the eviction and the one being evicted. During an eviction process, there are expenses that are incurred that include legal fees, court costs, lost rent, and maintenance fees.

The costs incurred during an eviction process include;

        Legal Fees: Most times, you will need to hire an attorney to help you evict the tenant. This is so because the eviction process itself tends to be complicated and the paperwork required needs to be accurate. Even a typo can cause delays and other problems. Attorneys charge hundreds of dollars an hour and this could translate to a lot of money

It is imperative to note that the more experience a lawyer has, the more the charges.


        Court Costs: All states charge filing fees, even though the costs may vary depending on the court. Tenants often dispute evictions. A disputed eviction that s being represented by a council can make the process all the more complicated.

A jury trial, motions, and discovery drags out the process and consequently raises the legal fees leading to further wasted time and lost rent.

 

        Lost Rent: During the legal process, the rent continues to accrue and despite the ruling of the court, you may still be owed rental debt. If there is damage to property, time spent doing repairs or reconstructing will eat into the time your property is vacant and this is a loss in income.

Other additional costs may be incurred when preparing the property for rent, showing property, and advertising

        Property Turnover Costs: On top of the income loss, you will also incur turnover costs. Payments towards mortgage and HOA dues that were covered by the tenant will be your responsibility. You will incur maintenance service fees, property management fees, and advertising costs.

        Property Damages: A tenant that is facing eviction- which means they won’t be collecting their deposit- will not be motivated to clean the premises. If the tenant leaves behind their belongings, you will need to store them. Cleaning, storage, or disposal of these belongings will cost you

        Financial Damages: Even if the court rules in your favor, collecting your debt from a tenant that is most likely being evicted for not paying rent is almost futile.
